UK Changes Immigration Rules: Skilled Workers Facing Exploitation Get New Freedom to Leave Abusive Jobs

Major UK Immigration Rule Changes: New Protection for Skilled Workers Facing Modern Slavery

Skilled Worker visa holders who have been victims of exploitation could soon have greater freedom to change jobs, under a major set of changes to the UK’s Immigration Rules.

The UK Government has announced a new package of immigration rule changes that includes additional protection for migrant workers who have suffered exploitation or modern slavery.

The changes, announced on 3 September 2026, are particularly significant for people who came to the UK through the Skilled Worker route and subsequently found themselves trapped in abusive or exploitative employment.

Under the new rules, qualifying victims will be able to take up employment in any occupation for the remainder of their existing visa, giving them an opportunity to leave an abusive employer without immediately losing their right to work in the UK.

The Government says the measure is intended to reduce the risk of victims being exploited further and encourage people who have suffered abuse to report what has happened to them.

Greater freedom for victims of exploitation

The Skilled Worker immigration system normally ties a migrant worker’s permission to work to the job and sponsoring employer specified on their visa.

That arrangement can create a difficult situation for someone experiencing exploitation. A worker may be reluctant to leave an abusive workplace because finding another sponsored position can be complicated and losing sponsorship could potentially put their immigration status at risk.

The new protection is designed to address that vulnerability.

Where a person legally entered the UK as a Skilled Worker and has subsequently been formally recognised as a victim of modern slavery, they will be permitted to work in any occupation for the remaining period of their current visa.

This means eligible victims will have considerably more flexibility to find alternative employment rather than remaining dependent on the employer who exploited them.

Migration and Citizenship Minister Jo White said the Government wants to make sure immigration rules do not leave vulnerable workers exposed to further exploitation.

The Government has also stressed that action against employers who abuse the sponsorship system will continue.

According to the ministerial statement, UK Visas and Immigration has revoked more than 7,500 sponsor licences, including around 1,800 in the care sector.

Why the change matters

For migrant workers, the fear of losing their job can sometimes become much more than an employment concern.

A worker whose immigration permission is connected to a particular sponsor may feel they have little choice but to tolerate poor working conditions, excessive demands or abusive treatment.

The Government’s latest change recognises that vulnerability and attempts to create a safer route out.

By allowing recognised victims to work elsewhere without being restricted to their original occupation, the Government says it hopes victims will feel more confident about coming forward.

The measure is also intended to make it harder for unscrupulous employers to use the sponsorship system as a tool for exploitation.


UK Set to Expand Erasmus+ Opportunities

The immigration changes are not limited to modern slavery protections.

The new Statement of Changes also contains measures designed to support the UK’s participation in Erasmus+, following the agreement for the UK to rejoin the programme.

The revised rules will create additional opportunities for people coming to Britain through Erasmus+ for activities such as education, training, work placements, traineeships and certain sporting activities.

The changes affect several immigration routes, including the Visitor, Student and Government Authorised Exchange routes.

More opportunities for Erasmus+ participants

Under the revised Visitor rules, eligible Erasmus+ participants will be able to undertake short-term study placements at UK state schools and academies.

These placements can last for up to six months, subject to the relevant requirements and safeguards.

The rules will also allow Erasmus+ participants to take part in activities such as workshops, debates and skills competitions.

Additional provisions will permit eligible participants to undertake courses, receive or provide training and participate in traineeships with UK organisations and educational institutions.

There will also be opportunities for Erasmus+ participants involved in sport to undertake coaching and training assignments with UK-based sporting organisations under the visitor route.

Changes to the Student visa route

The Student immigration route is also being adjusted to accommodate Erasmus+ activities.

Eligible participants will be able to undertake certain study programmes at RQF Level 2 and above, or the equivalent SCQF Level 5 and above in Scotland.

The new arrangements also remove some existing requirements that could otherwise make Erasmus+ courses difficult to accommodate within the UK’s student immigration framework.

For example, certain Erasmus+ courses will not have to lead to an approved qualification.

The Government is also changing rules concerning courses that include work placements and the organisations that can sponsor certain students.

State-funded schools and academies will additionally be able to obtain sponsor licences for eligible incoming Erasmus+ students.


A New Government Authorised Exchange Route for Erasmus+

Another significant change is the introduction of a dedicated arrangement within the Government Authorised Exchange (GAE) route.

The new scheme will allow eligible Erasmus+ participants to come to the UK for certain supernumerary work placements and internships.

This is intended to give Erasmus+ participants greater scope to gain practical experience in the UK while taking part in the programme.


Other Immigration Changes You Should Know About

The latest Statement of Changes contains several other amendments that may affect different groups of migrants and families.

Family Returns Process

Families involved in the Family Returns Process will receive a new route for raising certain Article 8 private or family life claims directly with Home Office officials.

Under the revised arrangements, they will be able to raise these issues without submitting a formal valid application, paying an application fee or completing a specified form.

Fee Waivers and Biometrics

The Government is also changing procedures surrounding fee waiver requests and biometric enrolment.

Some of these amendments are aimed at preventing people from repeatedly submitting applications or varying their applications in ways that could potentially be used to circumvent the immigration system.

Previous Immigration Breaches

There is also a clarification concerning the circumstances in which an applicant can be regarded as having previously breached immigration law by attempting to frustrate immigration controls.

The changes specifically address situations involving people who failed to report for immigration bail or absconded while on bail or in custody.

In certain circumstances, such conduct can now provide grounds for refusal.


Changes to the EU Settlement Scheme

The EU Settlement Scheme (EUSS) is also affected by the latest amendments.

One change is designed to provide greater flexibility for certain people with pre-settled status who no longer meet the scheme’s eligibility requirements.

In some circumstances, they may be allowed to remain under the EUSS where removing their status would be considered disproportionate.

The Government is also updating provisions concerning family members who are joining someone in the UK for the first time, as well as the evidence that applicants can use to demonstrate eligibility.


Hong Kong BN(O) Route Gets an Important Change

There is also good news for certain dependent children on the Hong Kong BN(O) route.

The existing five-year continuous residence requirement is being removed for eligible dependent children.

This means qualifying children may be able to settle in the UK alongside their parents without having to meet the previous five-year residence requirement, provided all other relevant requirements are satisfied.


Domestic Abuse Protection Extended

Another notable amendment concerns the Victim of Domestic Abuse route.

The route is being expanded to include certain adult dependent children where their relationship with their visa sponsor has broken down because of domestic abuse.

The change could provide an important immigration safeguard for vulnerable family members who might otherwise find themselves facing uncertainty after leaving an abusive situation.


Student Maintenance Requirement Also Increasing

International students should also take note of a separate change.

The financial maintenance requirement under the Student route is being increased in line with the maintenance loan levels available to home students for the 2026/27 academic year.

This means some prospective students will need to demonstrate access to a higher level of funds when applying under the relevant immigration rules.


When Will the New Rules Take Effect?

The changes will not all come into force on the same day.

Although the Statement of Changes was laid before Parliament on 3 September 2026, the different provisions will be introduced in stages.

The implementation dates include:

  • 8 October 2026
  • 29 October 2026
  • 30 November 2026
  • 9 December 2026

The precise date applicable to an individual will depend on which part of the Immigration Rules affects their circumstances.

What This Means for Migrants in the UK

The latest announcement represents a mixture of protection, procedural changes and new opportunities.

For Skilled Workers who have experienced modern slavery or serious exploitation, perhaps the most significant development is the ability, in qualifying circumstances, to move into another occupation without being restricted by their original sponsored job for the remainder of their visa.

For Erasmus+ participants, the changes open the door to a wider range of educational, training and work-related activities in Britain.

Other groups-including certain families, EUSS applicants, Hong Kong BN(O) dependants, domestic abuse victims and international students-will also be affected by individual changes.

Anyone whose immigration status may be affected should therefore check the specific rule and implementation date that applies to their circumstances rather than relying solely on the general announcement.

The Government’s message is clear: while it continues to tighten parts of the UK’s immigration system, it is also introducing measures intended to protect vulnerable migrants and make it easier for legitimate education and exchange programmes to operate.

With several of the changes coming into force later in 2026, migrants and employers should pay close attention to the updated Immigration Rules before making important decisions about work, study or visa applications.
